Terms of Service

Plain English: Design whatever you like. Your photos stay yours. Don't upload things you don't have the rights to, or things that are illegal. Prints are made to order, so we can't take them back unless something is wrong with them — and if something is wrong with them, we will fix it.

1. Accepting these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Paper Mache (“Paper Mache,” “we,” “us”), covering your use of papermache.io, our iOS application, and any print products you order from us (together, the “Service”).

By creating an account, uploading a photo, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service, and at least 16 if you are in the European Economic Area or the United Kingdom. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian, and only they may place orders.

2. Your account

We sign you in with a one-time link sent to your email address, or through Google or Apple. You are responsible for keeping access to that email account secure, because anyone with access to it can sign in as you. Tell us at hello@papermache.io if you believe your account has been accessed by someone else.

You agree to give us an email address that is accurate and that belongs to you, and to keep it current. You may not share an account, sell it, or transfer it to someone else.

3. Your content and who owns it

“Your Content” means the photos you upload, the poster layouts you create, the titles you give them, and any comments you write.

You keep every right you already had in Your Content. We do not claim ownership of your photos. We do not sell them. We do not use them to train machine-learning models. We do not use them in our marketing unless you give us separate, explicit permission in writing.

By uploading Your Content, you represent and warrant that:

This matters more than it may look. Photographs taken by a professional photographer are usually owned by the photographer, not by the person in the picture — wedding, newborn, school and graduation photos are the usual traps. If you are not sure you hold the right to print an image, get written permission before you upload it.

4. The licence you give us

To run the Service at all, we need your permission to handle Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, reformat, resize, crop, colour-correct, transmit and display Your Content, and to transmit it to our print and shipping partners, solely for these purposes:

That licence exists only for as long as we need it to do those things. It ends when you delete Your Content or close your account, subject to the retention periods in our Privacy Policy (for example, we keep records of completed orders for as long as tax law requires, and deleted files can persist in encrypted backups for a short period before they are overwritten). We have no other rights in Your Content.

We do not proactively review Your Content, and we are not obliged to. But we may review, refuse to print, or remove content that we reasonably believe breaks these rules, and we may cancel and refund an order for that reason.

Copyright complaints

If you believe content on the Service infringes your copyright, email legal@papermache.io with: identification of the work, the URL of the material, your contact details, a statement that you have a good-faith belief the use is unauthorised, a statement under penalty of perjury that your notice is accurate and that you are authorised to act, and your signature. We remove infringing material and terminate repeat infringers.

6. Sharing and collaboration

You can create a link that lets other people view or comment on a poster, and you can invite named people to edit one with you.

A share link is a key. It contains a long random token, but anyone who has the link can open it — we do not check who they are. Do not put a poster behind a share link if you would not be comfortable with a stranger seeing it, and do not post share links publicly. You can revoke a link at any time from the Share menu, which immediately stops it working.

Collaborators you invite can change or delete a poster you own. Choose them accordingly. If you delete a poster, it is deleted for everyone.

7. Orders, prices and payment

Designing a poster is free. You pay only when you order a print. Prices shown at checkout include the print, the frame or finish you chose, and any options you selected. Taxes, duties and shipping are shown separately before you pay.

Payments are processed by Stripe. We never see or store your full card number. Placing an order is an offer to buy; the contract forms when we send you an order confirmation. If a price is obviously wrong (a pricing bug, a currency error), we may cancel the order and refund you in full rather than honour it — we will tell you if we do.

Because prints are manufactured to your design, production begins shortly after you pay. You can cancel an order free of charge before production starts; after that it cannot be cancelled. We will tell you at checkout roughly how long that window is.

8. Print quality, returns and refunds

Every poster is a custom, made-to-order item personalised to your specification. Under consumer law in most jurisdictions — including the EU Consumer Rights Directive and the UK Consumer Contracts Regulations — personalised goods are excluded from the usual 14-day cooling-off right. So we cannot accept a return simply because you changed your mind.

Your legal rights are not affected, and we go further than we have to. If your print arrives damaged, defective, or materially different from what you designed, tell us within 30 days of delivery at hello@papermache.io with a photo of the problem. We will reprint it or refund it, at your choice. You will not have to ship it back.

What is not a defect

9. Shipping

Prints are produced and shipped by our print partner from the production facility nearest to you. Delivery estimates are estimates, not guarantees, and we are not responsible for delays caused by carriers, customs or weather.

The address you enter is the address we ship to. Check it. We cannot redirect a parcel once it has been dispatched, and we are not responsible for an order shipped to an address you typed incorrectly. Risk of loss passes to you on delivery. If your country charges import duties, you are responsible for them.

10. Our intellectual property

The Service itself — the software, the editor, the layouts and templates, the frame and filter designs, the name “Paper Mache,” the logo, and the look and feel — belongs to us and is protected by copyright and trademark law. These Terms give you permission to use the Service, not to copy it. You may not copy, modify, reverse-engineer or create derivative works from it, except to the extent that restriction is unenforceable where you live.

If you send us feedback or a suggestion, we may use it freely, with no obligation to you. Do not send us feedback you consider confidential.

11. Availability and changes

We aim to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may change, suspend, or discontinue any part of it. If we discontinue the Service entirely, we will give you reasonable notice by email and a way to export your posters and photos before they are deleted.

We may update these Terms. If a change materially reduces your rights, we will give you at least 30 days' notice by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new Terms. Changes never apply retroactively to an order you have already placed.

12. Suspension and termination

You can delete your account at any time. When you do, we delete your posters and photos as described in the Privacy Policy.

We may suspend or terminate your account if you materially breach these Terms, if we are required to by law, or to prevent harm to other users. Except where you have uploaded illegal content or we are legally barred from telling you, we will give you notice and a chance to fix the problem first. If we terminate your account without cause, we will refund any order that has not yet gone into production.

13. Disclaimer of warranties

Except as expressly stated in these Terms and except for the print guarantee in section 8, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your requirements, that it will be secure or error-free, that colours will reproduce exactly, or that Your Content will never be lost. Keep your own copies of your photos. The Service is not a backup service and must not be relied on as one.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing here excludes a warranty that cannot lawfully be excluded, and if you are a consumer, your mandatory statutory rights are unaffected.

14. Limitation of liability

To the fullest extent permitted by law, Paper Mache and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, lost revenue, lost data, lost goodwill, or the cost of substitute services, arising from or relating to the Service — even if we were told such damages were possible.

Our total aggregate liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the total amount you paid us in that period, or (b) US$100.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnity

You agree to indemnify and hold Paper Mache harmless from any claim, demand, loss or expense (including reasonable legal fees) brought by a third party and arising out of Your Content, your breach of these Terms, or your violation of anyone's rights — most commonly, a claim that we printed a photograph you did not have the right to print.

16. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the courts located there.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer-protection laws of the country where you live, and you may bring proceedings in your local courts.

Before filing anything, please email legal@papermache.io. Nearly everything is faster to resolve that way, and we would rather fix the problem than argue about it.

17. Miscellaneous

These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is found unenforceable, the rest stays in force and the unenforceable part is narrowed to the minimum extent necessary. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to a successor in a merger or acquisition. Nothing here creates a partnership, agency or employment relationship.
